TERMS & CONDITIONS

BOOKING CONFIRMATION, RESERVATION DEPOSIT AND CANCELLATION 

-Availability is on a request and confirmation basis at the time of reservation. A reservation is only binding after it has been confirmed by Wanderlust Camper Co and a NON-REFUNDABLE reservation deposit of £150 minimum or 20% of hire rate if this equates to a higher deposit has been received and cleared by credit or debit card, BACS or cleared cheque.

Business Interruption Policy Supplement 

This policy supplement solely relates to any hire booked from the date of issue that is affected by Government restrictions, such as travel restrictions imposed and lockdown conditions during a Coronavirus outbreak.
If your hire is not affected by Government restrictions, or for dates from 2021 unaffected by restrictions, our standard terms and conditions apply, our cancellation policy, payment terms and terms of use.
  1. Fully transferable / flexible booking
    1. Fully transferable:
Any paid reservation that cannot go ahead because of Government travel restrictions imposed during the time of your hire will be full-credited for a future hire – with the freedom to choose any available dates to suit you within 12 months of your original travel date.
Regrettably, we are unable to offer any refunds due to cancellations caused by the Coronavirus pandemic and any associated Government Restrictions imposed as a result of the same.
1.2 Flexible booking:  Reserve with a 20% reservation fee with reduced payment schedule: For any 2020 hire date, the balance would be required 10 days prior reduced from our standard 6 weeks prior normally applied in our terms and conditions and is non-refundable. 
1.3 If Government restrictions are imposed during your hire, we would ask you to return immediately and we will credit any remaining hire as outlined here, from the next full day.
2. Where reservations are credited for future hire
2.1 i) Varying hire rates: If the new hire reservation is less than the value of the original hire – we will provide a further credit note against the difference for a future hire.
ii) If the new hire reservation is more than the value of the original hire – we will ask you to pay the difference, in accordance with our standard payment terms of 6 weeks prior (or immediately if less than 6 weeks to travel).
iii) If the difference is not paid in accordance with our payment terms, your hire will not be able to go ahead, and you may forfeit the credit in accordance with our standard cancellation policy.
2.2 New reservations are subject to the relevant Terms and Conditions of the transferred date.
2.3 If you prefer a refund, this may be considered upon request and for dates affected by Government restrictions only. Any refunds that will be granted will be on a case by case basis and be subject to standard cancellation policy and less our 20% reservation fee. It is expected that hires made since the implementation of this supplement will be covered by our fully credited reassurance outlined above.
3. Cancellations
3.1 If you wish to cancel your reservation outside of any Government travel restrictions, these can be made in accordance with our standard cancellation policy, in our standard terms and conditions, which are:
-Cancellations made 42 days or more: loss of reservation deposit (£150 or 20%) – with £60 refund if dates are re-let for the same rate.
-Less than 6 weeks before hire date: 50% of total hire charge – reduced to 30% charge if dates are re-let for the same rate
-4 weeks or less before the hire date: 100% of total hire charge – reduced to 60% charge if dates are re-let for the same rate
3.2 Fees retained from the reservation deposit are fees and charges that reflect the costs of administration, payment fees and payment processing including book-keeping and associated reconciliation, contract preparation and cancellation, refunding fees and processing, re-advertising and hire date release. The £150 or 20% reservation deposit is made up from a booking fee of £90 that includes payment processing, administration charge and vehicle charge for supply (relevant whether hired or not) with the remainder charged as a hire date holding fee. The hire date holding fee may be refunded at our discretion and we are under no obligation in respect of the same.
3.3 If you are required to cancel because you or a member of your party is ill, we ask that you make a claim for the cost of your hire and any associated costs with your hire with your travel insurers. We will not credit or refund your hire due to illness, isolation or delay as our vehicle will have been made available for your use during this time. We may be able to re-let at short notice and will consider a partial rebate, but this will be solely based upon our discretion and ability to do this and we are under no obligation in respect of the same.
3.4 Event or venue closure? If the event or place you are intending to go to has been cancelled or closed, where alternative travel is available / not restricted we will not provide a refund or credit note as your term of hire are for us to supply a campervan for a date and not an event or venue.
4.Travel Insurance
4.1 It is a condition of hire that you have an appropriate level of travel insurance that will cover cancellation, curtailment and illness. We will not ask for evidence of this, however it will be deemed that you accept this term with your reservation.
5. Terms of hire and use
5.1 Your hire will be subject to the relevant guidance for working in a safe workplace, hygiene and cleanliness guidelines, social distancing and travel safety. Please ensure you have read and understood the most up to date, relevant guidelines and advice prior to your reservation.
5.2 You must check-in line using our existing online check in system to provide all identification as required. You must follow the advice and information provided on our FAQs, Insurance & ID page and Online Check-in to ensure you have provided all required documents two weeks in advance. Or without delay for hire less than 2 weeks to travel to ensure processing and confirmation of insurance prior to pick-up.
5.3 You must adhere to social distancing on collection. You will receive of “how to use” video instructions as well as PDF view in advance and raise any questions prior, aimed to replace the traditional guided handover. Upon pick-up, you will be invited to step into the vehicle and we will stand outside. Please follow our instructions. To limit our own risk, we ask for one responsible adult to communicate with us on pick-up and the remainder of your party should remain in your vehicle until we have dispersed. You should wear a face covering if the Government advice confirms this.
5.4 By taking the vehicle you acknowledge our cleaning procedure (available on our website), acknowledge you have seen the campervan being sterilized with sterilising mist upon pick-up, with social distancing adhered to as outlined in 4.3, and therefore take the campervan at your own risk.
5.5 If you or a member of your party fall ill during your hire, you are obliged to inform us where possible 24 hours in advance or prior to return at the latest so we can take necessary measures to protect our workforce. It is entirely your decision whether you feel you wish to return early or undertake the whole hire period – as our stringent cleaning procedures will be adhered to upon return. We will require notice to take additional measures.
6. General Terms
6.1 This Business Interruption Policy Supplement 01.06.2020 together with our standard terms and conditions forms the entirety of the agreement between us.  No other documentation or communications between us will affect the implementation of interpretation of these terms save for any variation that is agreed between us in accordance with clause 6.2 below.
6.2 Should any variation or modification be required to these terms and/or our standard terms and conditions this must be agreed in writing and signed by both yourself and Wanderlust Camper Co. 
6.3 By making your reservation/continuing with your reservation you agree to be bound by both these terms and those contained within our standard terms and conditions.

WANDERLUST CAMPER CO TERMS AND CONDITIONS OF HIRE

 DEFINITIONS USED WITHIN: Where the following words appear, we mean:
  • You / Your / You’re – the person who has booked & person who will be driving the hire vehicle, if not the same. Each person is liable jointly and severally for all obligations to you pursuant to this agreement.
  • Us / We / Our – Wanderlust Camper Co Ltd and our agents.
  • Campervan – the vehicle declared on booking, Campervan Rental Hire agreement and insurance schedule cover.

1.TERMINATING THE AGREEMENT
1.1 We may terminate the agreement and repossess the campervan at any time, without notification and you will repay reasonable costs of repossessing the campervan including towing charges if you:                                                                                                                
- are in breach of any terms & conditions.                                                
- have obtained the campervan through fraud/ misconception.             
- appear to have abandoned the campervan.                                         
- have not returned the campervan on the agreed date or we reasonably believe that the campervan will not be returned on the agreed date.
- We consider on reasonable grounds that the safety of the passengers or the condition of the campervan is endangered.

1.2 You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges, safety deposit or insurance excess. 
1.3 You may cancel subject to our cancellation policy: The reservation fee of 20% is non-refundable and is made up from a booking fee of £90 that covers payment processing, administration charge and vehicle charge for supply (which are costs to us whether the campervan is utilised or not), with the remainder of the fee charged as a hire date holding fee. The hire date holding fee may be refunded at our discretion and we are under no obligation in respect of the same.
Cancellations made more than 6 weeks prior will incur no additional charges – with £60 refund form the reservation fee if dates are re-let for the same rate, at our discretion. Less than 6 weeks but more than 4 weeks – you will incur a charge of 50% of the total hire cost, which will be reduced to 30% charge if dates are re-let for same rate. Under 4 weeks you will incur a loss of 100% of total hire charge, reduced to 60% charge if dates are re-let for the same rate. These charges reflect our losses and expenses made from your cancellation.

2.SAFETY DEPOSIT, INSURANCE AND DAMAGES
2.1 A £250 safety deposit is required, payable by credit or debit card, BACS or cleared cheque only. Cash not accepted. This would cover minor damage internally or externally.
2.2 We reserve the right to increase the safety deposit for specific events or longer-term hire periods, at booking.  
2.3 If there is minor damage to the campervan, either inside or out or to any of the contents (or there are missing items) -or the campervan is not reasonably clean - we will deduct the cost of repairing the damage, replacement or cleaning where applicable from the safety deposit and refund the balance owed to you.  If you believe damage has occurred prior to your
 
rental, please notify us within 24 hours of your hire commencing, otherwise it shall be deemed that damage has occurred during your rental period. 
2.4 We will release the safety deposit within 7 days where the campervan is returned in the same condition it was let out. This includes interior / exterior condition, contents / cleanliness.
2.5 For your reassurance, we ask you to sign a vehicle condition  report upon collection and return of the campervan.
2.6 Upon returning the campervan, we will do a tertiary check back with you and a more detailed inspection will take place when cleaning within 48 hours. Where the campervan is returned in the dark, we will require good light to fully inspect.
2.7 Insurance covers damage to the campervan and property of a third party. You are liable for the first £1000. In the event of damage over the threshold of the safety deposit to the campervan, you will be liable to the sum of up to £1000, whether an insurance claim is processed or not. This means that if the insurance will not cover the damage for any reason, or the damage is below the value of the insurance excess and cannot be claimed, we will recover the cost directly from you. This would be payable upon demand.
2.8. Where an insurance claim has been rejected because of your negligence, you will be liable for the full cost of rectification or replacement to our campervan or third-party property.
2.9 Persons excluded from insurance: Those engaged wholly or partly in professional entertainment or professional sports. Jockeys or persons connected with racing of any sort. Foreign Service Personnel other than persons born in the UK.                                                      
2.10 The self-drive hire insurance criteria is for drivers who:                                                                                                         
- Have held full UK/EU licence for more than 24 months (licences from further afield must be referred in advance)                                                                            - Who have up to 6 points on their licence (providing they are two minor offences)                                                                                              
- Aged between 25-75                                                                                   
- Have no more than one fault or non-fault claim within 5 years        
- Who have not had their licence suspended for any period within the last three years.                                                                                      
- Have not obtained a BA, DD or UT conviction

2.11 The driver must supply the following to us to be insured:                                                                                          
- Valid driver’s licence (address and photo to be up to date)                  
- Cleared and traceable safety deposit                                                                                                         
- 2 forms of proof of address (must match drivers licence, less than 90 days from date of hire)                                                                              
- Online licence check code obtained from DVLA.                                                                                  
- Signed Campervan Rental Hire Agreement                                    
If not supplied, then insurance is not valid. No other drivers are insured unless confirmed in writing by us.
2.12 Items not covered by the insurance include amongst other things: front and rear bumper, roof lights, windows, wing mirror and external doors and hinges, campervan engine other than wear and tear, incorrect fuel or fuel contamination or the property of any third-party subject to the insurance.
2.13 You will be liable for any cost associated with the incorrect use of fuel and resolving any associated issues and repairs.
2.14 Damage or defective wheel and tyres are your responsibility. They have left our premises with serviceable tread and without defect- this is acknowledged on the vehicle condition report.
2.15 You must have our consent to carry out repairs.
2.16 If your claim is due to theft, attempted theft, malicious damage or vandalism, you must notify the police within 24 hours of discovery of the loss or as near as practical and obtain a crime report number, as well as notifying us immediately.
2.17 Glass/windscreen cover excess is £80 and repairs excess are £25. There is no cover for roof vents.  
2.18 Replacements keys – you are liable for associated costs.
2.19 Personal belongings are covered in some instances from theft or damage in an accident of up to £100, subject to an insurance claim and associated excess. Cash and credit cards are excluded.
2.20 It is a condition of hire that you take out adequate travel insurance for your personal belongings and to cover your holiday expenses should there be a cancellation by us or yourself, injury or illness. This should be bought once your hire is confirmed to ensure maximum protection for your costs.

3. USE OF THE VEHICLE
3.1 You must always park in gear with the hand-break on.
3.2 At no time should the campervan keys be left in the vehicle while unoccupied, or keys be left with an unauthorised person.
3.3 Towing with the campervan is not permitted.
3.4 Weight limits and pay loads are on our website. It’s the driver’s responsibility to not exceed the gross vehicle weight or individual axel weight and that the campervan and contents do not exceed the advised pay load. You can be fined or get a court summons if the campervan exceeds its maximum permitted axle weight. We are not liable for any weight calculations on your behalf.
3.5 The insured campervan shall not be used for the carriage of any commercial goods or used for a commercial purpose. You shall not carry goods of an explosive, dangerous or hazardous nature, or passengers for hire or reward, or any other form of profit or remuneration; or for racing, pace making, testing the campervan reliability and speed or teaching someone to drive.
3.6 The campervan shall not be taken outside of the UK.

4. BREAKDOWN COVER
4.1 We will supply full breakdown cover to cover any mechanical faults to the campervan. Recovery from a non-solid road surface, is not covered. Do not drive into water or on beach or boggy flooded land / terrain.
4.2 In the unlikely event of breakdown, no responsibility will be accepted by us for any loss, damage, or expense which occurs because of any defect or breakdown.
4.3 Call out charges from operator error or mismanagement eg flat battery / flat or defective tyre / broken windows or screen, are not covered. In the event of a flat tyre, campervans are supplied with temporary inflation foam. Please call us for advice.

5. PETS
5.1 Pets are only allowed by prior agreement.
5.2 A charge of £35 applies where the campervan is not returned reasonably clean, whether or not a pet is authorised.
5.3 It is a legal requirement that drivers need to ensure ‘dogs or other animals are suitably restrained’. Seat belt clips are provided. It is your responsibility to bring suitable equipment to secure your dog. Failure to do so may invalidate your insurance.

6. SMOKING
6.1 You must not smoke in the campervan, this includes e-cigarettes, vaping and any form of smoking apparatus.
6.2 You will be liable for any damage caused to the campervan and an additional cleaning fee of £65.

7. PASSENGERS
7.1 It’s the driver’s responsibility to ensure all passengers are wearing seatbelts and not exceed the number of passengers to belted seats fitted.   
7.2 Child seats are not provided.  You must bring your own and installing these are the driver’s responsibility.

8. LPG GAS
8.1 You must only replace with Calor blue cylinders and follow instructions provided in the campervan. If you undertake replacement, you a responsible for ensuring the correct fit.
8.2 Our gas connections and installations are inspected annually as required by law. The Gas Safety Certificate is available in the campervan for your inspection.

9. RESPONSIBILITY WHEN AN ACCIDENT OCCURS
9.1 In the event of any accident or damage to the campervan, you must notify us immediately for advice and assistance.
9.2 You must obtain names, addresses and details of all witnesses / parties & report to the police. Please take photographs if possible. You will be required to supply an accident / incident report.
9.3 You are advised not to make any admission of liability, settlement offer or other similar offers to any parties involved as this may hinder an insurance claim.
9.4 Following an incident, you must ensure that the campervan is safe and secure as you continue to be liable for any further incidents that could occur if not secured safely.
9.5 You agree to assisting us, to the best of your ability in handling any claim arising from any event during your hire period including providing all relevant information and attending court to give evidence where needed.
9.6 You are responsible for damage and associated costs not covered by an insurance claim, during your hire.  

10. MAINTENANCE
10.1 You are advised to undertake reasonable steps to properly maintain the campervan during your hire period including oil checks, water and batteries. Failure to do so and any damages or losses resulting from lack of maintenance during your hire period will be your responsibility.
10.2 You must report any maintenance issues as soon as possible.  If we provide a request which you do not adhere to, you will be liable for any consequential damage.

11. RETURN
11.1 The campervan must be returned by 11am, unless agreed in advance. We do not refund if you return early.
11.2 Late returns will incur a charge of £50 per hour for up to 3 hours from the return time. After this time, you will be charged the relevant full day hire fee. You must keep us informed.
11.3 You will be liable for any additional costs that may be incurred to us or in respect of the follow-on hire. Likewise, we will extend the same courtesy to you by pursuing reasonable costs occurred by the previous hire, if the return is late on your collection day.

12. YOUR PRIVACY
12.1 The General Data Protection Regulation stipulates that we can hold copies of your identification for as long as we feel necessary. Our insurance recommends this for 24 months.  See our Privacy and Data Policy for more details.
12.2 A tracking device is fitted to the campervan to enable recovery of the campervan if it is stolen or for unauthorised use or where we suspect breach of this agreement.
12.3 We will not use this data for any purpose that will infringe your privacy. The data will not be shared with any other party, unless we are required by an agent authorised to request it.  
12.4 Any tracking data will not be kept after 6 months unless there is a specific reason to do so, in which case, you will be advised. You can request a copy of this data.

13. OTHER CHARGES
13.1 Refilling the fuel tank is charged at fuel cost plus £30 fee. This will be deducted from the safety deposit.
13.2 All fines, charges, and penalties incurred by you during your hire are your responsibility. Your details will be passed to those authorised to request it.
13.3 During or relating to your rental period, you are responsible for any charges arising from Customs and Excise or Immigration Authorities seizing the campervan together with a loss-of-income charge while we cannot hire out the campervan.
13.4 You are liable for any costs incurred with a late return whether from lateness or incident, that affects a follow-on hire (see 11.2 and 11.3) except mechanical breakdown, where it is deemed not to be operator error. This includes but not limited to the loss of follow-on rental charges affected and costs incurred that relate to accident repairs or replacement.
13.5 Mileage is included at 500 miles week (or on a pro rata basis for a part week). We will notify you of your mileage allowance. Exceeding the mileage allowance is charged at £40 per block of 500 miles (or part thereof). This is payable upfront, upon return or from your safety deposit.
13.6 If the toilet is unemptied a charge of £50 will be due.
13.7 All charges and expenses payable by you under this agreement are due on demand. If you do not pay all charges when due, we will charge a late payment fee of 1.5% per month on the outstanding balance and any collection cost incurred.

14. EVENTS BEYOND OUR CONTROL
14.1 Unfortunately, events beyond our control may affect bookings resulting in cancellation, delays or damage.
14.2 We cannot be held responsible for any changes in our insurance policy imposed by the insurers or any law changes. We will update our terms accordingly and notify where we can.
14.3 If an accident or breakdown of a previous hirers forces us to cancel your rental, we will refund your rental charges.  Unfortunately, we cannot accept any responsibility or pay any compensation, or other costs or other expenses incurred. This includes any delays to and/or restrictions to your hire to which you may be subject. We recommend you take out travel insurance to the cover you deem adequate.
14.4 We will do our best to ensure you are a happy customer and a replacement will be offered if we can, although we are under no obligation to do so.
14.5 In severe weather conditions, particularly when a weather warning has been issued, we may refuse use of the campervan where we believe you or the campervan could be endangered. In this instance we will provide a full refund. 

15. ENTIRE AGREEMENT
15.1 This agreement is governed by the laws of the country in which it is signed. Any dispute may and must be settled in the courts of that country.

16. RELEASE AND INDEMNITY
16.1 Subject to our obligation to deliver the campervan you release us, our employees and agents, from liability to you (regardless of who is at fault) for any loss, damage or injury incurred by you, including all members of your party, by reason of this agreement, including but not limited to:
- Any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for your purpose;                    
- Any loss or damage to any property left in our campervan.  
16.2 Subject to any insurance arrangements agreed with us, you hereby indemnify and shall keep us indemnified, our employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by you or any member of your party by reason of your use and/or possession of the vehicle.
16.3 RELEASE You hereby waive and release any claims against us, our employees or representatives, for any injuries or death that may be sustained by you on or near or adjacent to the campervan, including any common facilities, activities or amenities, outside of the self-drive hire insurance. You agree to use any such facilities or amenities entirely at your own initiative, risk and responsibility.
